Privacy Policy

This Privacy Policy describes what personal and other information FIBR FIT (“FIBR” or “we” or “us”) gathers from you, how this information is used and protected, and what choices you have about how your information when you access and use our website, online platform and associated services at www.fibr.fit (collectively, the “Website”) for fitness and wellness professionals to connect with one another and the larger community.  This Privacy Policy applies only to information collected by FIBR as described in this policy.

 

This Privacy Policy is incorporated into and subject to our Terms & Conditions of Use https://www.info.fibr.fit/terms (“Terms & Conditions”).  By using the Website, you agree, without limitation or qualification, to be bound by this Privacy Policy.  If you do not agree to the terms in this policy, please do not access our Website.

 

Please know that any information (including personal information) you reveal in a website public forum (such as a message board, online meetings, posting, chat room/event, or similar electronic public venues) is not protected by this Privacy Policy. Such postings may be seen by members and/or guests and third parties not related to FIBR. What personal and other information you may provide could be used by others in ways we are unable to control or predict, including to contact you for purposes you did not authorize.  Rules for posting content on the Website are set forth in the Terms & Conditions.

 

FIBR’s Website may contain links to other websites. FIBR is not responsible for the privacy practices of such other websites. FIBR encourages you to read the privacy statements of each website that you visit. This Privacy Policy applies solely to information collected by FIBR through its Website as described in this policy.

 

Security

FIBR has implemented commercially reasonable precautions to protect users’ personal information. When users submit information via the Website, your information is protected both online and offline. We use industry standard practices to protect your information, such as encryption, firewalls and other technologies. We use a cloud provider to host the Website, which they maintain in a secure environment.  Also, we have implemented SSL (Secure Sockets Layer) encryption technology to further protect your interactions with the Website and regularly test their security.   We retain your personal information for a period of time consistent with the original purpose of collection to provide you with the services you have requested, or as long as required to fulfill our legal obligations.

 

Registered members are advised not to share your account login information or password with anyone.  We cannot be responsible for a data breach or other incident if your password is used by unauthorized persons.

 

Personal Information We Collect

To obtain access to certain portions of the FIBR Website, we may ask you to provide us with various pieces of personal information.  Certain areas of the Website may ask for additional information on your habits or interests to include on your profile.  If you are a registered member seeking to make purchases online, we may also ask for identifying information that will enable us to process your orders. Providing this personal information allows us to contact you and distinguish you from other users. Personal information may include your name, street address (including city, state and zip code), telephone number, birth date (primarily for eligibility purposes), and billing and credit card information.

 

If you make purchases through the Website we need to gather information relating to the sale, including what products you are buying, how you are paying and where you would like the products shipped (“Transactional Information”). However, we will use that Transactional Information only to complete the transaction, to provide you with an order history and to facilitate future orders. We may also use information about the transaction for aggregate reporting (where we summarize the data in a report that does not contain your personal information).

 

You can always contact us to (1) update, correct or delete your personal information, or (2) change your preferences with respect to communications and other information you receive from us by sending an email to: privacy@fibr.fit.  Any updates, corrections, changes, and deletions will not have an effect on other information that we maintain, or information that we have provided to third parties in accordance with this Privacy Policy prior to the update, correction, change, or deletion. 

 

You should be aware that it is not technologically possible to remove each and every record of the information you have provided to us from our system. The need to back-up our systems to protect information from inadvertent loss means that a copy of your personal information may exist in a non-erasable form that will be difficult or impossible for us to locate.

 

Membership and Account Creation

In order to access certain services and features on the Website, you may need to become a member by registering and creating an account with us.  When creating a member account, you will be asked to provide us with certain personal information, such as your first and last name, email address and mailing address. In addition, you are requested to choose a username and unique password for use on the Website. This information is used to create a user account for you in the system, which enables you to access online services or products.   We also request your daytime phone number, shipping address, and financial information (credit card type, number, expiration date and billing address). These details are used to complete your order and used for billing purposes only.  We may use third party payment processors to handle payment functions.  Be advised that we are not responsible for the privacy practices of these service providers. 

 

In conjunction with registering as member, you will be asked to set up a “profile” that will be viewable by other members.  You control what information is included in your profile but may include your education, work experience, skills, interests, photo, city or area.  PLEASE DO NOT POST OR ADD PERSONAL INFORMATION TO YOUR PROFILE THAT YOU WOULD NOT WANT TO BE PUBLICLY AVAILABLE.  You and other members may post content that includes information about you (as part of articles, posts, comments, videos) on the Website.

 

Other Information:

In order to maintain and improve the Website, we also automatically gather some technical and statistical data when you visit this site. The exact information we collect may vary but can include: the date and time of access to the Website, the IP address of your device requesting a page, the pages requested, computer and connection information such as browser type and operating system. We do not associate this device or statistical information with your personal information.  We may use third party analytics providers to help us understand and use this data.  Also, if you respond to a poll, we will aggregate your responses with those of other responders, but we do not associate your response with any personal information.  We collect general location information only for usage analytics.  Your precise location is not needed to use the Website and we do not collect it. 

 

Also, we collect information about you when you send, receive, or engage with messages to other members or to us in connection with the Website.

 

How We Use Information We Collect:

As noted, we gather information for purposes of providing and improving the Website for you. For example, we use information about you, such as your profile, to enable other members to find you on the Website and communicate with you via the Website.  We use the information to allocate system resources and communicate with you about updates and new features, among other things. We also aggregate information supplied by users during registration and information about their use of the Website to maintain our services and describe our user base to potential partners, investors and advertisers. In providing this aggregated data about our community of users, however, we do not reveal any user's personal information.

 

In addition, we may use your personal information to inform you of other products or services available and/or its affiliates may contact you via surveys to conduct research about your opinion of our current products, services or potential new services that may be offered.  You can opt out of receiving our promotional messages by emailing us at: privacy@fibr.fit or by clicking on the “Unsubscribe” button at the bottom of the message.   Please note, however, that you cannot opt out of receiving communications from us about products or services you have purchased or other transactional or administrative information.

 

We may engage other companies to perform functions on our behalf, such as fulfilling orders, delivering packages, providing customer service, sending emails, processing credit card payments, holding live chats, hosting message boards or other functions necessary for us to provide services to you. We may need to share your personal information with these companies for them to provide these services. However, we will provide them with only the minimum information necessary to perform their functions and will not allow them to use that information for any other purposes.  These companies are contractually obligated to protect the security of personal information we share. We do not rent, sell, transfer or otherwise disclose your personal information to any third party for their purposes.   

 

We may reveal your personal information as necessary, if we reasonably believe that you are harming or interfering with the Website other users, anyone else, or violating (either intentionally or unintentionally) our Terms & Conditions, or infringing any of FIBR’s rights, or trespassing on, damaging, or abusing any of our property.  In addition, we may need to reveal information, including personal information, to the extent we are legally obligated to do so. In addition, if we are asked by subpoena or other legal means to disclose any of your personal information we will, if permitted by law, attempt to notify you via any email address we have on file for you at least ten (10) days before we respond to the request. In addition, FIBR may transfer any information, including any personal information, in connection with a sale of all or most of the assets of the company and the Website.

 

Cookie Usage

A cookie is a piece of data stored on your computer’s hard drive that contains information about you and your computer. The cookies used on the Website do not contain any identification that would be useful to another individual or organization. We use cookies, for example, to look up your member information and sign you in to a specific service.   While you use the Website, the cookie stores your member ID so you don't have to log on more than once during a session thereby saving time while on the Website. Once you log out or close the browser, the cookie is deleted from your computer.

 

The following is a description of the types of cookies used on the Website:

  • Strictly Necessary Cookies: These cookies are strictly necessary to provide the Website. For example, they are used to authenticate and identify returning users.  You cannot opt out of these cookies.

  • Performance and Functionality Cookies: These cookies provide statistical information on site usage, such as web analytics.  They also help us to personalize and enhance your online experience.

  • Advertising Cookies: These cookies are used to create profiles or personalize content to serve you interest-based advertisements that we think are most relevant to you.  These cookies and resettable device identifiers use information about your use of this and other Website and apps, your response to ads and emails, and to deliver ads that are more relevant to you.

 

Some of these cookies may be active during the time you are viewing a website (“session cookies”).  Other cookies may remain on your computer after you have closed your browser or turned off your computer (“persistent cookies”). However, we do not use tracking cookies on other websites.

This Privacy Policy does not cover the use of cookies used by third parties, and we are not responsible for their privacy policies and practices. Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our Website.

 

Online Advertising

Online advertisers may download cookies onto your compute or other device, or use other technology like web beacons, to enable them to recognize your computer or other device each time they send you an advertisement, even when you are visiting another website. As a result, the advertiser would have the ability to deliver interest-based advertisements that they believe would be of most interest to you. We do not have access to or control of the cookies that may be placed on your computer by third-party advertisers.

Be advised that these opt-out tools are provided by third parties and may not be available with respect to all interest-based advertising that is presented to you. We do not control or operate these tools or the choices that advertisers and others provide through these tools.  Even if you opt out of receiving interest-based advertising, you may still receive generic ads. 

 

We may deploy Facebook Pixels on the Website, which would enable us to target ads on Facebook.  At this time, we do not otherwise engage in interest-based online advertising.

 

Google Analytics

We use Google Analytics to collect information regarding usage of the Website and help us to manage and improve it. Google provides a Browser Add-On that allows you to opt-out by downloading and installing the add-on for your web browser, available at https://tools.google.com/dlpage/gaoptout.  

 

We will make reasonable efforts to ensure your personal information is accurate and complete and we will update or correct your information as needed when notified by you. If you would like to request access to your personal information, request to verify your personal information, confirm the accuracy of our personal information, or change your personal information in any way, please contact us at: privacy@fibr.fit.  You can also request that we delete your personal information.  However, deleting your information may result in your not being able to access some or all of our services.

 

Web Site Traffic Data

We collect aggregated and/or de-identified traffic data software on our servers to analyze trends and gather broad demographic information to improve our services and products. This information is not linked to any personal information and cannot reveal your identity.  We reserve the right to disclose this aggregate and de-identified information to service providers.

 

Located in United States

FIBR and our Website are located and hosted in the United States (US) and governed by US law. If you are outside the United States when you visit the Website or engage in communications with us via mail, email or telephone, please be aware that your personal information may be transferred to, stored, and processed in the United States.  Any information you provide to us, or that we collect through your use of the Website and will be stored, processed, and transferred within, or to, the United States. Please be aware that the United States and jurisdictions other than the one in which you are located may not provide the same level of data protection as considered adequate in your country. Note also that your personal information may be available to the US Government or its agencies under legal process in the United States.

 

EEA and UK Privacy Rights

For residents of the European Economic Area (EEA) and United Kingdom (UK), we advise that your personal information will be transferred to and processed in the United States, which has data protection laws that are different than those in your country and may not be as protective. The United States has not received a finding of “adequacy” from the European Union under the General Data Protection Regulation (GDPR) or from the UK under the UK GDPR. Our legal basis for collecting and using your personal information is to do so with (i) your consent, (ii) where we need the personal information for performance of a contract or requested service, or (iii) where the collection and use is in our or another’s legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms.  In some cases, we may also have a legal obligation to collect the personal information in question. Our retention of your personal information and any subsequent communications are based on our legitimate interest in providing you with the requested services and new and potentially relevant services or products based on your geography, role, or company. As always, you can elect to opt out from receiving certain types of future communications as described in this policy.

 

To the extent that we transfer personal information from the EEA or UK to another jurisdiction that has not been determined by the European Commission or UK as providing adequate data protections, we will ensure that such personal information is safeguarded through appropriate contractual terms or other approved mechanisms.

  • Find out if we use your personal information, to access your personal information, and receive copies of your personal information.

  • Withdraw any express consent that you have provided to the processing of your personal information at any time without penalty.

  • Access your personal information and have it corrected or amended if it is inaccurate or incomplete. Note: Where personal information is processed solely for clinical research, access may be restricted and/or denied. Whenever possible, we will honor your right to access by redacting information if your request would otherwise be restricted and/or denied.

  • Obtain a transferable copy of some of your personal information which can be transferred to another provider when the personal information was processed based on your consent.

  • If you believe your personal information is inaccurate, no longer necessary for our business purposes, or if you object to our processing of your personal information, you also have the right to request that we restrict the processing of your data pending our investigation and/or verification of your claim.

  • Request your personal information be deleted or restricted under certain circumstances. For example, if is using your personal information on the basis of your consent and has no other legal basis to use such, you may request your personal information be deleted when you withdraw your consent.

 

Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

 

If we ask you to provide personal information to us to comply with a legal requirement or enter into a contract, we will attempt inform you of this and let you know whether providing us with your personal information is required and if not, the consequences of not sharing your personal information with us. 

 

Similarly, if we collect and use your personal information in reliance on our or a third party's legitimate interests and those interests are not already described above, we will let you know what those legitimate interests are. 

 

We endeavor to apply suitable safeguards to protect the privacy and security of your personal information and to use it only consistent with your relationship with us and the practices described in this Privacy Policy.

If you are not satisfied with our response, or believe we are processing your personal information in violation of the law, you have the right to lodge a complaint with the Supervisory Authority (also known as Data Protection Authority) or other appropriate governmental authority in your EEA Member State or UK. 

 

Unless specifically authorized, GDPR prohibits processing of certain special categories of data such as race, ethnicity, political and religious beliefs, sexual orientation, genetic, and biometric data. We do not knowingly acquire or process any data belonging to these categories.

 

Canada

For visitors or users of the Website in Canada, we take appropriate steps to comply with applicable Canadian data privacy requirements, including the Anti-Spam Legislation (CASL) and the Personal information Protection and Electronic Documents Act (PIPEDA).  Note, however, personal information stored or processed outside of Canada, including in the US or another foreign country, may not be subject to the PIPEDA.  In addition, personal information stored or processed outside of Canada is subject to the laws of that other country and may be available to the foreign government of the country in which the personal information or the entity controlling it is located pursuant to a lawful order in that jurisdiction.  This Privacy Policy is intended to provide the required notices regarding our collection and use of personal information, including transfer to the United States. 

 

You may request to access, correct, or delete your personal information, or withdraw consent to our collection, use or disclosure of your personal information, by contacting us at: privacy@fibr.fit.

 

These rights are subject to applicable contractual and legal restrictions and reasonable notice. We may take reasonable steps to verify your identity before honoring any such requests.

 

California

For California residents under the age of 18 and registered users of the Website, California law (Business and Professionals Code § 22581) provides that you can request the removal of content or information you posted on the Website.  Any such request should be sent to us at either email at: privacy@fibr.fit along with a description of the posted content or other information to be removed.  Be advised, however, that applicable law may not permit us to completely or comprehensively remove your deleted content or for other reasons as set forth in California law. 

 

Pursuant to California’s “Shine The Light law (California Statute § 1798.983), California residents are entitled, once a year and free of charge, to request the disclosure of certain categories of personal information to third parties for their own direct marketing purposes in the preceding calendar year, if any.  You may request this information by contacting us at admin@interpayments.com and indicate in the email subject line, “California Shine The Light Request.”  Please include your mailing address, state of residence and email address with your request. 

 

We do not sell your personal information to third parties for their purposes.

 

Your Choices and Rights

Members can access and update their personal information from within their account and on their profile.

 

Subject to applicable law, an individual has the right to request from us a copy of what personal information, that we have collected or to ask to correct or update their it. Individuals can also request that we delete their personally identifiable information from our systems and records. We strive to respond to these requests with 30 days or as required in accordance with applicable law.

 

Whenever you directly provide us with your personal information, please be sure it is accurate and complete. We cannot be responsible for any information you provide to us that is incomplete or incorrect.

 

We will not collect, use, or disclose your personal information in any ways or for any purposes that are materially different from those set forth herein. However, if we wish to do so in the future, we will obtain your consent first, and offer you the choice to opt-out of such proposed collection, use, or disclosure.

 

If we send you promotional or marketing messages, such as to an email you provide when you register and open an account, you will be able to opt out of receiving our marketing or promotional email communications by using the “Unsubscribe” feature at the bottom of each email from us or by requesting to opt out by emailing us at privacy@fibr.fit.  Please note that you cannot opt out of receiving transactional communications from us regarding services you request, your account with us or other transactional or administrative issues.

 

Do Not Track

Some web browsers and devices allow you to broadcast a preference that your activities online not be “tracked.” At this time, the Website does not honor “do not track” signals.

 

Children

You must be 18 years or older to register as a member and otherwise access and use the services offered on or through the Website or do so with your parents’ or guardians’ permission.   The Website are not intended for children under 13 years old.    We do not knowingly collect personal or other information from persons under 13 years of age. If you are under 13, you should not provide your personal information to us.   If you believe that we might have any personal information from a child under 13, please contact us at the details as provided below so that we may delete it. 

 

No Rights of Third Parties

This Privacy Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of the Website.

 

Policy Changes

If we change this privacy policy in any material way, we will notify you at least 30 days in advance by posting a notice of the change prominently on our Website or sending an email to our registered members. Changes will not be applied retroactively to information obtained under a previous policy without your express consent.
